Privacy Policy

This Privacy Policy ("Policy") explains how Kiss My Art LLC ("FriendGammon," "we," "us," or "our") collects, uses, discloses, and protects information in connection with the FriendGammon mobile application, website, and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you ("you" or "Player") acknowledge that you have read and understood this Policy.

If you do not agree with this Policy, do not use the Service.

1. Scope

This Policy applies to information we collect through the Service. It does not apply to third-party websites, apps, or services that may link to or be linked from the Service. We are not responsible for the privacy practices of third parties.

2. Information We Collect

a. Information You Provide Directly

Account information: first name, last name, username, profile photo, and phone number.
Communications: messages you send to us (e.g., support emails) and content you post in in-app chat or other communication features.
User content: game history, custom avatars, profile images, and any other content you submit.

b. Information Collected Automatically

Device & technical data: device model, operating system and version, unique device identifiers (e.g., IDFA, Android Advertising ID, where permitted), mobile network information, language, time zone.
Usage data: features used, screens viewed, in-app actions, session duration, crash logs, performance data, and gameplay statistics.
Network data: IP address and approximate location derived from IP (city/country level only — we do not collect precise GPS location).
Cookies and similar technologies as described in Section 9.

c. Information from Your Device (with permission)

Contacts: if and only if you affirmatively grant contacts permission, we access your device contact book to identify other Players you may know and, if you opt in separately, to send invitations. You can revoke this permission at any time in your device settings. We do not retain contacts of non-Players longer than necessary to perform the requested matching, and we do not sell contact data.
Photos / camera: if you upload a profile image, we access only the photo(s) you select.
Push notification tokens: if you enable notifications.

d. Information from Third Parties

If you sign in or interact via a third-party platform (e.g., Apple, Google, Facebook), we receive information that platform makes available, in accordance with that platform's terms and your privacy settings.

e. Payment Information

We do not collect or store payment card or bank account information. All in-app purchases are processed by the Apple App Store or Google Play Store, and we receive only transaction confirmation data (e.g., that a purchase was completed, the SKU purchased, and a transaction identifier).

3. How We Use Information

We use the information we collect to:

Operate, maintain, and improve the Service;
Create and manage your account and authenticate you;
Match you with other Players and enable social features;
Process transactions and deliver virtual items;
Send transactional and service-related communications (e.g., account notices, security alerts);
Send marketing communications where permitted, with the ability to opt out;
Personalize your experience;
Detect, prevent, and respond to fraud, cheating, abuse, security incidents, and violations of our Terms of Service;
Comply with legal obligations, enforce our agreements, and protect our rights and the rights of others;
Conduct analytics and research to understand how the Service is used.

Legal bases (EEA / UK users): We process personal data on the bases of (i) performance of a contract; (ii) your consent (which you may withdraw at any time); (iii) our legitimate interests in operating, securing, and improving the Service; and (iv) compliance with legal obligations.

4. How We Share Information

We do not sell personal information. We share information only as follows:

Service providers: vendors who help us operate the Service (e.g., cloud hosting, analytics, push notifications, customer support, anti-fraud, crash reporting). These providers are contractually limited in how they may use information.
Other Players: your username, profile photo, in-game stats, and chat messages are visible to other Players you interact with.
Legal & safety: to comply with applicable law, regulation, legal process, or governmental request; to enforce our terms; to protect the rights, property, or safety of FriendGammon, our Players, or others; to detect or prevent fraud, security, or technical issues.
Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, in which case information may be transferred as part of that transaction. We will notify Players of any such transfer.
With your consent: in any other case where you direct us to share or have given consent.
Aggregate / de-identified data: we may share information that has been aggregated or de-identified such that it cannot reasonably be used to identify you.

5. Third-Party Services and SDKs

The Service incorporates third-party software development kits ("SDKs") and services (for example, analytics, crash reporting, push notification, and advertising identifiers). These third parties may collect information governed by their own privacy policies. A current list of material third-party providers can be requested at hello@friendgammon.com.

6. International Data Transfers

We are based in the United States. If you access the Service from outside the United States, your information will be transferred to, processed, and stored in the U.S. Where required, we rely on appropriate safeguards (such as the Standard Contractual Clauses) for international transfers.

7. Data Retention

We retain personal information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. When information is no longer needed, we delete or de-identify it. You can request deletion at any time as described in Section 8.

8. Your Rights and Choices

Depending on where you live, you may have the right to:

Access the personal information we hold about you;
Correct inaccurate information;
Delete your information ("right to be forgotten");
Object to or restrict certain processing;
Lodge a complaint with a supervisory authority.

California residents (CCPA/CPRA): You have the right to know what categories of personal information we collect, use, and disclose; to request deletion; to correct inaccurate information; to opt out of "sale" or "sharing" (we do not sell or share personal information as those terms are defined under California law); and to be free from discrimination for exercising these rights.

To exercise rights, contact hello@friendgammon.com. We will verify your identity before responding. We will respond within the timeframes required by applicable law.

You may also:

Disable contacts, photos, location, or push notification permissions in your device settings;
Reset or limit ad tracking via your device settings (e.g., "Limit Ad Tracking" on iOS, "Reset advertising ID" on Android).

9. Cookies and Similar Technologies

The Service may use cookies, local storage, SDKs, and similar technologies to remember preferences, analyze usage, and personalize content. You can control cookies through your browser settings; disabling them may affect Service functionality.

We do not currently respond to "Do Not Track" browser signals.

10. Children's Privacy

The Service is not directed to children under 13 (or under 16 in jurisdictions where that is the applicable minimum). We do not knowingly collect personal information from children under that age. If we learn we have collected personal information from a child under the applicable age, we will delete it promptly. Parents or guardians who believe their child has provided personal information to us should contact hello@friendgammon.com.

11. Security

We implement reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

12. Push Notifications and Marketing

If you opt in, we may send push notifications and marketing messages. You can disable push notifications in your device settings and unsubscribe from marketing emails at any time. Transactional and service-related messages may continue.

13. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will notify you within the Service or via the contact information on file. Your continued use of the Service after the effective date of the updated Policy constitutes acceptance.

These Terms of Service ("Terms") govern your access to and use of the FriendGammon mobile application, website, and related services (collectively, the "Service"), operated by Kiss My Art LLC ("FriendGammon," "we," "us," or "our"). Please read these Terms carefully.

IMPORTANT: Section 18 contains a binding arbitration clause and class action waiver that affect your legal rights. Please read it carefully. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, downloading, accessing, or using the Service, you ("you" or "Player") agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

You must (a) be at least 13 years old (or the minimum age required in your jurisdiction, whichever is higher); (b) have the legal capacity to enter into a binding contract or have a parent or legal guardian consent on your behalf; (c) not be barred from using the Service under applicable law or by prior FriendGammon enforcement action; and (d) not be located in a jurisdiction where use of the Service is prohibited.

If you are a minor, your parent or legal guardian must read and agree to these Terms.

3. Account Registration and Security

You agree to (a) provide accurate, current, and complete registration information; (b) maintain and update it; (c) keep your login credentials confidential; (d) be solely responsible for all activity under your account; and (e) notify us immediately at hello@friendgammon.com of any unauthorized use.

You may register only one account per individual. We may refuse registration, reclaim usernames, or terminate accounts at our discretion.

4. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Service on a device you own or control, solely for your personal, non-commercial use. All rights not expressly granted are reserved.

5. User Content and License to Us

"User Content" means any content you submit, post, or transmit through the Service (e.g., username, profile image, chat messages, in-game communications).

You retain ownership of your User Content. By submitting User Content, you grant FriendGammon a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and display the User Content in connection with operating, providing, and promoting the Service.

You represent and warrant that (a) you own or have the necessary rights to your User Content, and (b) your User Content does not violate these Terms or any third-party rights.

6. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms;
Use bots, scripts, automation, scrapers, exploits, modified clients, emulators, or any unauthorized third-party software to interact with the Service;
Cheat, collude with other Players, manipulate matchmaking, or otherwise gain an unfair advantage;
Reverse engineer, decompile, disassemble, or attempt to derive source code from the Service, except to the extent permitted by applicable law;
Probe, scan, or test the vulnerability of the Service or breach any security or authentication measure;
Interfere with, disrupt, or impose an unreasonable load on the Service;
Harass, threaten, defame, stalk, intimidate, or impersonate any person; This will result in 1 warning, then immediate and irreversible account deletion.
Post content that is obscene, hateful, sexually explicit, violent, infringing, or otherwise objectionable;
Solicit personal information from minors or transmit content harmful to minors;
Sell, trade, transfer, or attempt to monetize accounts, virtual items, or virtual currency outside the Service;
Use the Service to advertise, promote, or solicit any business, product, or service without our written consent;
Encourage or assist any third party in doing any of the foregoing.

Violations may result in warnings, suspension, or permanent termination, at our sole discretion and without refund.

7. Virtual Items and Virtual Currency

The Service may offer virtual items, virtual currency, in-game tokens, or other digital content (collectively, "Virtual Items"). Virtual Items:

Are licensed to you, not sold, and you do not own them;
Have no monetary value and cannot be redeemed for cash or any thing of value outside the Service;
Are non-transferable and non-refundable except where required by law;
May be modified, suspended, or eliminated by us at any time without compensation;
Are forfeited upon termination of your account.

You agree that any payments you make for Virtual Items are final. Refunds, if any, are governed by the platform from which you made the purchase (Apple App Store or Google Play) and applicable law (including, where applicable, EU/UK consumer rights to withdraw within 14 days, except where the digital content has been delivered with your prior consent).

8. No Real-Money Gambling

FriendGammon is intended for entertainment only. The Service does not offer real-money gambling, prizes redeemable for cash, or wagering. If you are located in a jurisdiction where the form of play offered constitutes regulated gambling, you may not use the Service.

You are solely responsible for determining whether your use of the Service is lawful in your jurisdiction. We make no representation that the Service is appropriate or available in any particular location.

9. Anti-Cheat and Fair Play

We may use automated and manual systems to detect cheating, fraud, and abuse. We may, at our discretion: roll back game results, void wins, remove Virtual Items, suspend or terminate accounts, and refuse to provide service. Decisions of FriendGammon administration regarding fair play and tournament results are final.

10. Chat and Communications

You are solely responsible for content you transmit via in-app chat or other communications features. We do not pre-screen User Content but reserve the right to monitor, review, remove, or refuse any content at our discretion. Repeated or serious violations may result in account termination.

11. Intellectual Property

The Service, including all software, graphics, audio, text, design, trademarks, logos, and other content (excluding User Content), is owned by Kiss My Art LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership to you.

"FriendGammon" and the FriendGammon logo are trademarks of Kiss My Art LLC. All other trademarks are the property of their respective owners.

12. DMCA / Copyright Infringement

If you believe content on the Service infringes your copyright, send a notice to hello@friendgammon.com containing:

A physical or electronic signature of the copyright owner or authorized agent;
Identification of the copyrighted work claimed to be infringed;
Identification of the allegedly infringing material and information sufficient to locate it;
Your contact information;
A statement that you have a good faith belief that the use is not authorized;
A statement, under penalty of perjury, that the information is accurate and you are authorized to act.

We may terminate accounts of repeat infringers.

13. Third-Party Platforms (Apple App Store / Google Play)

You acknowledge that these Terms are between you and FriendGammon, not Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content.

Apple App Store Additional Terms (applies if you obtained the app from the Apple App Store):

These Terms incorporate by reference Apple's Licensed Application End User License Agreement.
The license granted is limited to use on Apple-branded products you own or control, in accordance with the Usage Rules of the Apple Media Services Terms.
Apple has no obligation to furnish any maintenance and support services for the Service.
In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Service infringes intellectual property rights.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play Additional Terms (applies if you obtained the app from Google Play):

These Terms supplement Google Play's Terms of Service.
Google is not a party to these Terms and has no obligations relating to the Service.

14. Termination and Suspension

We may suspend or terminate your access to the Service, with or without notice, for any reason, including breach of these Terms. You may terminate your account at any time by contacting hello@friendgammon.com or using in-app deletion tools (where available).

Upon termination: (a) your right to use the Service ends immediately; (b) any Virtual Items associated with your account are forfeited; (c) Sections that by their nature should survive (including Sections 5, 7, 8, 11, 14–25) will survive.

15. Service Availability

The Service is provided on a best-efforts basis. We may modify, suspend, or discontinue the Service or any portion of it at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.

16. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, the above exclusions apply to the extent permitted.

17. Limitation of Liability

To the maximum extent permitted by law, in no event will FriendGammon, Kiss My Art LLC, or its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangibles, arising out of or relating to the Service, whether based on contract, tort, strict liability, or any other legal theory, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

These limitations apply to the maximum extent permitted by law and do not limit liability that cannot be limited under applicable law (e.g., gross negligence, willful misconduct, or, where applicable, consumer rights under EU/UK law).

18. Dispute Resolution; Binding Arbitration; Class Action Waiver

Please read this section carefully — it affects your legal rights.

a. Informal Resolution. Before filing a claim, you agree to attempt to resolve the dispute informally by contacting hello@friendgammon.com. We will attempt to resolve the dispute within 60 days.

b. Binding Arbitration. Except for disputes that may be brought in small claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by [JAMS / AAA] under its applicable rules. The arbitration will be conducted in [Florida/USA], or by video, at the arbitrator's discretion. Judgment on the award may be entered in any court of competent jurisdiction.

c. Class Action Waiver. You and FriendGammon agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

d. Opt-Out. You may opt out of this arbitration agreement by sending written notice to hello@friendgammon.com within 30 days of first accepting these Terms. The notice must include your name, account information, and a clear statement that you wish to opt out.

e. Exceptions. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.

19. Governing Law and Venue

These Terms are governed by the laws of the State of [Florida], without regard to conflict-of-laws principles. Subject to Section 18, any judicial action must be brought exclusively in the state or federal courts located in [Broward, Florida], and you consent to personal jurisdiction there. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

If you are an EU/UK consumer, mandatory consumer protections of your country of residence are not affected by this clause.

20. Indemnification

You agree to defend, indemnify, and hold harmless FriendGammon, Kiss My Art LLC, and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party right; or (e) your violation of any applicable law.

21. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications failures, pandemics, fire, flood, or other natural disasters.

22. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide notice within the Service or by other reasonable means. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.

23. Notices

We may provide notices to you via email, in-app notification, or posting within the Service. You may send notices to us at hello@friendgammon.com.

24. Assignment

You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign or transfer these Terms freely, including in connection with a merger, acquisition, financing, or sale of assets.

25. Miscellaneous

Entire Agreement. These Terms (together with the Privacy Policy and any policies referenced) constitute the entire agreement between you and FriendGammon regarding the Service.
Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
No Third-Party Beneficiaries. Except as expressly stated (e.g., Apple under Section 13), there are no third-party beneficiaries.
Headings. Section headings are for convenience only and have no legal effect.
Export Controls. You agree to comply with all applicable U.S. and international export laws and regulations.
Government Use. The Service is "commercial computer software" and "commercial computer software documentation." Any use, modification, reproduction, or distribution by the U.S. Government is governed solely by these Terms.
Language. These Terms were drafted in English. Any translation is for convenience only; the English version controls.
